1. Service Contract and Liability
A veterinary treatment contract is a service contract. Except for advisory services, the veterinarian is not obligated to deliver a specific result, but rather to make an effort. The fee is not compensation for results, and no guarantee is given for the success of an operation or treatment. The clinic is not liable for damage or loss of animals due to accidents, infections, or slight negligence on the part of clinic staff. Claims for recovery, repeat treatment or surgery, reduction of the fee, or compensation are excluded.
2. Variable Effort
The effort required to fulfill the service contract may vary due to serious illnesses or unforeseen complications.
3. Emergency Measures
The clinic is authorized to perform necessary treatments for the animal's well-being without the express consent of the owner.
4. Duty to Provide Information
The owner or authorized representative is obligated to report any animal's health problems upon admission.
5. Risk Information
The owner/authorized representative has been informed that any treatment entails an increased burden and risk of infection for the horse. The risks of treatments, surgeries, and the necessary anesthesia have been explained.
6. Therapeutic Need and Food Processing
The owner/authorized representative consents to the horse being treated with medications not approved for food-producing animals in the event of a therapeutic need. It is understood that the horse may not be used for food production. Processing for food is a violation of the Food and Commodities Act. The owner/authorized representative must ensure that the horse is listed as a non-slaughter animal in the horse passport.
7. Right of Retention
TeamVet Centre NL B.V. is entitled to exercise the right of retention if fees – including those arising from the treatment of other horses owned by the same owner – have not been fully paid.
8. Provision of Information
The owner/authorized representative must obtain any requested information about the course of the disease themselves. Information will only be provided by the treating or on-call veterinarian. Other employees may not provide information.
9. Professional Confidentiality
Our employees are obligated to maintain confidentiality in accordance with internal clinic regulations.
10. Jurisdiction
The Gelderland District Court is recognized as the competent court for all disputes.
11. Severability Clause
Should any provision of this agreement be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision of economic equivalent value. This also applies to any gaps in the contract.
